Welcome to Original Indian Kitchen (“OIK,” “we,” “us,” or “our”). By accessing or using our website, mobile application, or any related services (collectively, the “Services”), you agree to be bound by these Terms & Conditions (“Terms”). Please read them carefully before placing an order for pickup or delivery.
1. Acceptance of Terms
By using our Services, you confirm that you are at least 18 years old or have the consent of a parent or guardian, and that you have read, understood, and agree to these Terms.
2. Ordering & Payment
Orders may be placed:
+ In person at our restaurant.
+ Over the phone, with credit/debit card payment accepted.
+ Through third-party delivery platforms, including DoorDash and Uber Eats.
Payments for in-person or phone orders are processed by OIK and card details are not stored after the transaction is complete.
Payments for third-party platform orders are processed by that provider, and their payment terms apply.
All prices are listed in U.S. dollars and are subject to change without notice.
3. Pickup & Delivery
Pickup orders: Orders placed in person or over the phone are picked up inside the restaurant during posted business hours.
Delivery orders: Delivery is available only through approved third-party providers (currently DoorDash and Uber Eats). Delivery terms, fees, estimated times, and service areas are determined by those platforms and may vary.
We are not responsible for delays, missing items, or service issues related to third-party delivery orders.
4. Cancellations, Changes & Refunds
For in-person or phone pickup orders: Changes or cancellations must be requested immediately by calling the restaurant. We cannot guarantee changes can be made after food preparation has begun.
Refunds for in-person or phone orders are issued at OIK’s sole discretion.
Refunds for third-party delivery orders must be handled directly with the platform where the order was placed (e.g., DoorDash, Uber Eats).
5. Food Allergies, Sensitivities & Dietary Requests
Our kitchen uses a variety of fresh and dry ingredients, including but not limited to nuts, dairy, gluten, soy, shellfish, and eggs.
We are not a gluten-free, nut-free, dairy-free, or allergen-free kitchen.
While we make every reasonable effort to accommodate allergies, sensitivities, and spice preferences, we cannot guarantee the complete absence of allergens in any menu item.
Customers are responsible for informing us of any allergies or sensitivities when placing an order.
6. Intellectual Property
All content on our website and app — including but not limited to text, images, logos, and menu descriptions — is the property of OIK and may not be copied, reproduced, or distributed without our written consent.
7. Third-Party Services
Our Services may link to or integrate with third-party platforms such as DoorDash and Uber Eats.
We are not responsible for the content, policies, or practices of these providers. Your use of their services is subject to their own terms and privacy policies.
8. Limitation of Liability
To the fullest extent permitted by law, OIK shall not be liable for any damages arising from your use of our Services, including but not limited to order errors, delivery delays, or issues caused by third-party providers.
9. Changes to These Terms
We may update these Terms at any time without prior notice. Continued use of our Services after updates constitutes acceptance of the new Terms.
